Pearl Market, the Downtown farmers market in and around Pearl Alley, is turning away some vendors after city officials ruled that they cannot set up shop on the sidewalks on Broad and Gay streets.

“We’ve been doing it since 2008 and the city licensing section came to us and made us aware that it’s not allowed under the city code,” said Adam Schroeder, the market’s manager. He said nine vendors won’t be able to sell at the markets this week and others will have to scale back to one day a week to share booth space.

Schroeder said he’s trying to fit as many vendors as he can into the space where they are allowed to sell along Pearl and Lynn alleys. And his boss, Cleve Ricksecker, executive director of the Capital Crossroads Special Improvement District, is talking with City Council members about a code change.

City license enforcers couldn’t make an exception for the Pearl Market while enforcing the code elsewhere, said Amanda Ford, spokeswoman for the Columbus Department of Public Safety.

“There are so many people who enjoy the market so we don’t want to shut down the market, that’s not our goal at all,” she said.

“It’s just a matter of being consistent in your enforcement.”

Unlike the Pearl Market vendors, food carts that operate on city sidewalks have a special permit to do so.

Mayor Michael B. Coleman has asked Public Safety officials to find a solution to the problem.

Councilwoman Michelle M. Mills, chairwoman of the council’s safety committee, said she’s looking for a approach that can be applied to the entire city.

The Pearl Market organizers “reached out to us, and I think we’ll find a solution,” she said. “I’m confident.”

Less than a week after being named state schools superintendent, Stan W. Heffner could be the target of an ethics investigation.

A Democratic lawmaker today asked Inspector General Randy Meyer to launch a probe into whether Heffner improperly tried to steer state business to a company for which he planned to go work.

Rep. Debbie Phillips, D-Athens, says Heffner, while serving as interim state superintendent and after accepting a job with Educational Testing Services, advocated for legislation that would have benefited the company, which provides certification tests for Ohio teachers.

“Mr. Heffner gave testimony before the Senate Finance Committee in support of legislation that likely meant significant revenues for his new employer. This official action on his part seems to violate the spirit, if not the letter, of Ohio’s ethics law,” Phillips wrote in a letter to Meyer.

Heffner, who has denied any wrongdoing, dropped plans to go work for the company last week after the Ohio Board of Education named him state superintendent.

The inspector general’s office had no comment about the complaint. As a general rule, the office does not confirm or deny whether it has received a complaint or whether it will do an investigation, said Deputy Inspector General Carl Enslen.

A North Side man has been indicted on a charge of attempted murder after authorities say he used Molotov cocktails to firebomb a rape victim’s apartment in an attempt to intimidate her.

John Eugene McFarland, Jr., 29, also was charged with intimidation and two counts of aggravated arson. All of the counts are felonies.

On May 26, a 71-year-old woman reported being raped in her North Side town house.

She said she was forced into her house on Red Robin Road after walking her dog, according to a search warrant filed in Franklin County Municipal Court. She told police a man raped her, then stole her car.

The next day, police arrested Andre Easley, 29, of the North Side. He was charged with felony counts of aggravated burglary, rape, kidnapping and two counts of robbery.

Twelve days after the assault, the woman’s town house burst into flames.

In a search-warrant affidavit, arson investigators said that McFarland bought gasoline and two 40-ounce bottles of King Cobra beer –  ingredients used to make homemade bombs known as Molotov cocktails –  at a gas station at Karl and Schrock roads. .

McFarland confessed to purchasing the items, according to the search warrant.

Court records show that both McFarland and Easley recently lived at 6136 Karl Rd. Easley is the boyfriend of McFarland’s wife, the search warrant said.

City texting bans have been all the rage, as many communities have outlawed the practice for safety.

There are not nearly as many cities that have gone as far as outlawing handheld devices all together.

The City of Worthington is expected to listen to testimony Monday night at city council to consider the issue.

It was brought forth last year, but the issue was tabled.

Some think a move like this would go too far.

“Yeah, if I can mess with my radio while I’m driving, can certainly mess with my phone.  I hold it so I can see the road,” Daniel Wilkens said.

A council member asked that the conversation be reopened.

Sharon Montgomery lost her husband to a distracted driver, and is expected to testify before the council.

“My husband died of his injuries, and I nearly died of my injuries,” Montgomery said.

During her testimony, she plans to lean on science.

“Our brains flip back and forth between two paths. They don’t perform both at once and they don’t perform either as well as if they weren’t flipping back and forth,” Montgomery said.

Some in the community think a Worthington handheld ban should go right along with the current texting ban in place.

“Someone turned in front of me on a one-way street going in opposite direction, never put their phone down, backed up and this is right in downtown,” Carol Schar said.

WASHINGTON — Even as Senate Republicans vowed a confirmation fight, President Barack Obama nominated former Ohio Attorney General Richard Cordray today to head a new consumer agency designed to simplify the complex credit card and mortgage transactions that often have confused ordinary Americans.

At a Rose Garden ceremony under a scorching hot sun, Obama said he was “proud to nominate” Cordray as the first director of the Consumer Financial Protection Bureau, which was created last year by Congress. For the past six months, Cordray has served as head of enforcement for the agency, which is scheduled to launch operations this week.

“Prior to this, as Ohio’s attorney general, Rich helped recover billions of dollars in things like pension funds on behalf of retirees, and stepped up the state’s efforts against unscrupulous lending practices,” Obama said. “He’s also served as Ohio’s treasurer and has successfully worked with people across the ideological spectrum  – Democrats and Republicans, banks and consumer advocates.”

Cordray, who stood next to Obama, Treasury Secretary Timothy Geithner and senior adviser Elizabeth Warren, did not make a statement or take questions from the assembled reporters. For months, Obama had been expected to name Warren to the director’s job, but the White House concluded she could not win a Senate confirmation battle.

Warren, who came up with the idea of a consumer protection bureau, has provoked intense opposition not only from Republicans but bankers who worry that the new agency will exercise sweeping powers over the American financial industry.

Senate Republicans have vowed not to confirm any nominee until the administration agrees to substantial revisions in the new agency. The GOP wants a board to supervise the agency rather than a single director such as Cordray. They also want Congress to have the power to appropriate the annual budget for the agency.

Senate Minority Leader Mitch McConnell, R-Ky., quickly signaled that Cordray would face just as difficult a confirmation battle as Warren would have. In a Senate floor speech after Obama spoke, McConnell said GOP lawmakers “still aren’t interested in approving anyone to the position until the president agrees to make this massive new government bureaucracy more accountable and transparent to the American people.”

But Obama made clear he plans to resist GOP efforts to revise the agency. He said, “We’re not going to go back to the status quo where consumers couldn’t count on getting protections that they deserved. We’re not going to go back to a time when our whole economy was vulnerable to a massive financial crisis.”

“That’s why reform matters,” Obama said. “That’s why this bureau matters. I will fight any efforts to repeal or undermine the important changes that we passed.  And we are going to stand up this bureau and make sure it is doing the right thing for middle-class families all across the country.”

One of the principles of spiritual prosperity is that of giving. Give today, whether it is of your time or of your material wealth. When you give, you prepare yourself to receive. When you worry less about yourself and concentrate on what you can do for others, you make this a better world and you open yourself to be blessed. If you have two of something, give one away.
